General terms and conditions for holiday rentals

The present rental is granted and accepted at the price, charges and special conditions indicated on the online order, of which the present terms and conditions form an integral part. Please read them carefully before committing yourself to renting Villa Evgenia.

LEGAL STATUS :

Seasonal rentals are entered into for temporary residence and pleasure. The premises may not be used as a principal residence, and the tenant may not engage in any commercial, craft or professional activity.

INFORMATION AND RESERVATION :

Prior to concluding the seasonal rental contract, the customer will find on the www.villa-evgenia.com website all the necessary information on the price, acts and elements of the stay, in particular the location of the accommodation, its type, capacity and main characteristics.
Reservations become binding once the full rental amount has been paid.

ENERGY COSTS

For rentals between June and August, energy consumption (water, electricity and gas) is included in the rental price. For the period from September 1 to June 30, energy consumption will be billed extra and must be paid to Ergatic on the basis of meter readings.

END-OF-STAY CLEANING

Rates vary according to the accommodation selected. Cleaning is generally included in the price.

TOURIST TAX

The tourist tax, collected on behalf of the municipalities, is reflected in our rates.

MOVING IN

  1. The contract takes effect from 3pm on the day of arrival and automatically terminates at 10am on the day of departure. The keys will be handed over on site, after verification that the balance of the rental has been paid by the tenant.
  2. If the tenant wishes to take possession of the rented premises outside working hours, he/she must contact Ergatic, who will inform him/her of the conditions for handing over the keys, on condition that the balance of the rental has been paid in advance by the tenant.
  3. If the tenant is unable to arrive on the first day of the rental period, it is imperative that he notifies Ergatic before the arrival date indicated in the rental contract.
  4. The tenant undertakes to take the rented premises in the condition in which they will be found on arrival, as described on the website www.villa-evgenia.com. The inventory of the apartment is considered to be in order. All installations and household appliances are considered to be in working order.
  5. Any complaint and/or anomaly concerning the accommodation must be reported no later than 48 hours after taking possession of the premises. Failing this, the premises and equipment will be deemed to be in good condition.
  6. In the event of urgent repairs to be carried out by the owner during the rental period, Ergatic will make every effort to arrange for the necessary repairs to be carried out. However, Ergatic accepts no responsibility for any delay in carrying out such work.

HOLIDAY INSURANCE - RENTAL RISKS :

  1. Children remain under the strict supervision of their parents or guardians.
  2. The tenant is required to take out insurance to cover the risks of theft, loss or damage to personal belongings, fire, glass breakage and water damage, as well as the risks of damage to the rented furniture caused by the tenant or his negligence.
  3. You should therefore check whether your main homeowner's policy includes a holiday extension. If it doesn't, he should contact his insurance company and ask for the extended coverage, or take out a special policy with holiday clauses.
  4. The parties agree that Ergatic can never be held responsible for theft, loss or damage to personal belongings belonging to the renter.
  5. The use of the material and various equipment made available to the hirer remains under the sole responsibility of the hirer, who declares that he/she has "civil liability" insurance covering all incidents or damage that may occur during the use of the latter. The lessee waives any right to hold Ergatic liable in any way whatsoever. He/she shall not hold the owner liable for any personal injury or material damage caused to third parties or to himself/herself.

 

TENANT'S OBLIGATIONS :

 

  1. The tenant must refrain absolutely from disposing of objects likely to block the drains (hygienic material, wipes, etc.) in washbasins, baths, sinks, WCs, etc. Otherwise, he/she will be liable for the costs incurred in restoring these appliances to working order.
  2. The tenant must ensure that the peace and quiet of the neighborhood is not disturbed by himself or his family. The tenant is obliged to occupy the premises personally, to live in them "as a good father of the family", and to maintain them.
  3. The hirer shall ensure that the premises are occupied by himself, the signatory of the contract, and any accompanying persons, without ever exceeding the stated capacity. Under no circumstances may the rental be used by third parties.
  4. The lessee must comply with all applicable regulations, by-laws and ordinances, in particular with regard to hygiene, safety, roads, police, public health and public peace. Particular attention will be paid to fire-fighting instructions, and any practice involving the possibility of fire must be prepared for rapid extinction.
  5. Parties and other events are not permitted except with the written consent of Villa Evgenia or when Villa Evgenia is being privatized.
  6. Under penalty of cancellation, the tenant may not, under any circumstances, sublet or assign his rights under this agreement. The premises presently rented must not under any circumstances be occupied by a number of persons greater than that indicated at the time of reservation, except with the written agreement of Villa Evgenia.
  7. Linen provided or rented to tenants must remain inside the accommodation. The use of towels provided is not authorized outside the accommodation.
  8. In the interests of ecology and economy, the tenant undertakes to use water (especially for showers) and electricity sparingly (especially the air-conditioning, which must not be left running in the tenant's absence). Excessive consumption during the stay may result in an additional charge of €50 for water and/or electricity.
  9. Water is for sanitary use only. It is recommended not to drink the water from the taps.
  10. The lessee signing the present contract concluded for a fixed period may under no circumstances claim any right to remain in the premises at the end of the stay.
  11. Smoking is strictly prohibited in the accommodation (ashtrays are available outside).
  12. Pets are tolerated in the rented premises, under the exclusive responsibility of the tenant. Their presence must be notified on arrival.
  13. In case of early interruption of the stay by the tenant, and if the owner is not responsible, no refund will be made. Some bookings from partner websites may have different cancellation conditions. Please refer to your confirmation email for bookings from partners.
  14. Due to the design and terrain of Villa Evgenia (tiered olive grove and sloping ground), it is not possible to secure all the downhill slopes, which means we cannot guarantee optimum safety for small children. It is therefore your responsibility to forbid access to your children or to accompany them and keep them under supervision. We accept no responsibility for any breach of these conditions.

THE LESSOR'S OBLIGATIONS :

The lessor undertakes to make the rented accommodation available to the lessee, in accordance with the description provided, and to respect the obligations arising from the rental contract.

INTERRUPTIONS CAUSED BY THE LESSOR

In the event of exceptional inaccessibility of the accommodation on the agreed dates, Ergatic will make its best effort to re-house you in accommodation of the same or higher category, as close as possible to that initially chosen, at the rates stipulated in the contract. Should this change not be possible, all sums paid will be returned to you.

TENANT INFORMATION

The tenant acknowledges having read all the information required for the proper operation of the accommodation received.

STARTING CONDITIONS :

The tenant is required to vacate the property and hand over the keys on departure. Ergatic is responsible for inspecting the property and drawing up an inventory of fixtures on departure (with photos if necessary). The tenant is not obliged to attend this inspection, unless he/she wishes to do so, in which case he/she must make an appointment with Ergatic 48 hours before departure.

ATTRIBUTION OF COMPETENCE :

For the performance of the present contract, the undersigned parties elect domicile in the rented premises, and agree that in the event of a dispute, the competent court will be exclusively that of the jurisdiction in which the rented accommodation is located.
